By accessing or using our website or booking a Seakart adventure, you agree to be bound by these Terms and our Privacy Policy (linked in the footer of our website). If you do not agree, please do not use our Services.

We operate water-based adventure experiences (“Adventures”) aboard Seakart vessels. Our Services include booking through FareHarbor, on-site check-in and waiver completion via Wherewolf, and optional complimentary digital photo albums via Fotaflo.

2. Eligibility

Participants must meet the following eligibility requirements:

  • Be of lawful age and physical condition to operate or ride a Seakart vessel, as defined by our safety rules and local boating laws.

  • Provide accurate and complete information when booking.

  • Agree to and sign our electronic waiver (via Wherewolf) before participating in any Adventure.

We reserve the right to refuse service to anyone who fails to meet these requirements or violates safety or conduct rules.

3. Booking & Payment

All bookings are processed securely through FareHarbor.
On-site merchandise and tips are processed via Square.

By booking through our website, you agree to FareHarbor’s Terms of Service andPrivacy Policy, as well as Square’sTerms andPrivacy Policy.

Refunds & Rescheduling

  • Weather: Adventures may be rescheduled or refunded in the event of unsafe weather conditions at Seakart Adventure SC’s discretion.

  • Customer Cancellations: Refund and rescheduling policies are determined by our booking partner FareHarbor and will be clearly stated at the time of purchase.

  • No-shows: Failure to appear for your scheduled Adventure without prior notice may result in forfeiture of payment.

4. Waivers & Liability

Before participating, all guests must complete a liability waiver via Wherewolf. The waiver outlines the inherent risks of water-based activities and releases Seakart Adventure SC, LLC from liability for injuries, losses, or damages incurred during participation.

By completing the waiver, you acknowledge and accept these risks voluntarily. Participation without a completed waiver is not permitted under any circumstances.

5. Safety & Conduct

All guests must follow staff instructions, wear provided safety gear, and adhere to all posted and verbal rules at all times.

Seakart Adventure SC reserves the right to deny or terminate participation without refund to any guest who:

  • Appears under the influence of drugs or alcohol

  • Fails to follow safety instructions

  • Poses a risk to themselves, other guests, or staff.

6. Digital Media & Photo Sharing

We use Fotaflo to deliver complimentary digital photo albums to guests following their Adventures.

By participating in an Adventure, you grant Seakart Adventure SC permission to capture photos and videos during your activity and to share them with you via Fotaflo.

With your consent, Seakart Adventure SC may also use selected photos or videos for marketing purposes on our website, social media, or promotional materials. You may opt out at any time by contacting info@seakartadventuresc.com.

7. Intellectual Property

All content on our website, including text, images, graphics, and logos, is the property of Seakart Adventure SC, LLC and protected under applicable copyright laws. You may not reproduce, distribute, or use any material from our site without written consent.

8. Disclaimers

  • Participation in Seakart Adventures involves inherent risks associated with water sports and motorized vehicles. By booking, you acknowledge these risks and agree to participate at your own discretion.

  • We make reasonable efforts to maintain accurate information on our website but make no guarantees of completeness, accuracy, or availability.

9. Limitation of Liability

To the fullest extent permitted by South Carolina law, Seakart Adventure SC, LLC and its affiliates, staff, or contractors are not liable for any indirect, incidental, or consequential damages arising from participation in Adventures, use of the website, or reliance on information provided.

10. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.
Any disputes shall be resolved in the appropriate courts located in Horry County, South Carolina.
